Terms of Use
Draft. This text is a carefully written draft, not legal advice. Items marked [PLACEHOLDER: ...] are to be completed by the owner.
These terms apply when you use the Drop Duel mobile game and this website (together, “Drop Duel”). By installing or playing the game online you agree to them. If you do not agree, please do not use Drop Duel.
Who we are
Drop Duel is provided by [PLACEHOLDER: full name or company name of the data controller], [PLACEHOLDER: postal address] (“we”). Contact: [PLACEHOLDER: contact email, e.g. a privacy@ or support@ address on koohan.net].
Using the game
We give you a personal, non-exclusive, non-transferable licence to install and play Drop Duel on your own devices. The game, its code, graphics, sounds and name belong to us or our licensors. You may not copy, modify, reverse engineer or resell it, except where the law allows.
You must be at least [PLACEHOLDER: minimum age] years old, or have the permission of a parent or guardian where the law requires it. Your use of the app stores is also governed by Apple’s and Google’s terms.
Accounts
- You can play offline without an account. Online play uses an anonymous guest account; some features (friends, invites, using one profile on several devices) need an account with your email address and a 6-digit login code.
- Give a real email address that you control, and keep access to it. Anyone who can read that inbox can sign in to the account.
- You can delete your account at any time in the game. See Delete your account. We may also delete guest accounts that stay unused for a long time.
Fair play
Online matches are refereed by our server. You agree not to:
- cheat, use bots, scripts, modified clients or automation, or exploit bugs to gain an advantage;
- manipulate rankings, for example by deliberately losing, arranging matches with others or using several accounts;
- attack, overload or probe our servers or other players’ connections;
- attempt to get into other people’s accounts or data.
We may reset results, remove records or ranks, suspend or delete accounts that break these rules, with or without warning where needed to protect other players.
Player names and content
Your player name is visible to other players. Do not use names that are offensive, hateful, impersonate others, contain personal data or infringe someone’s rights, or that suggest a connection with us. We may change or remove a name and take action on the account. Drop Duel has no chat or user-uploaded content at the moment; if that changes, these terms will be extended.
Availability and changes to the game
Drop Duel is provided as is. Online features need our server and may be unavailable at times, for maintenance, updates or reasons outside our control. Old versions of the app may stop connecting after an update (the game will tell you to update). We may change, add or remove features, and may stop the game, in which case we will give reasonable notice where we can.
Our responsibility
We do not exclude liability that cannot be excluded by law, such as for intent, gross negligence, death or personal injury, or your statutory consumer rights. Beyond that, and as far as the law allows, we are not liable for indirect or consequential loss, lost progress, rankings or records, or for interruptions of online services. Our total liability for anything related to Drop Duel is limited to the amount you paid us for it in the last 12 months, or to [PLACEHOLDER: amount, if the game has paid features] if nothing was paid. Consumers keep all mandatory rights of their country.
Privacy
How we handle personal data is described in the Privacy Policy and, for Turkey, the KVKK notice.
Changes to these terms
We may update these terms, for example when the game gets new features. We will change the date above and, for material changes, tell you in the game before they apply. If you keep playing after the change takes effect, you accept it; if you do not, you can delete your account.
Governing law and disputes
These terms are governed by [PLACEHOLDER: governing law, e.g. the laws of the Republic of Türkiye]. Disputes go to [PLACEHOLDER: competent courts or consumer arbitration committees], without limiting the rights you have as a consumer under the mandatory laws of your country. If you have a problem, please write to us first at [PLACEHOLDER: contact email, e.g. a privacy@ or support@ address on koohan.net]; most things are solved that way.
